Terms & Conditions for Public Sales

General Terms and Conditions (APPLIES TO ALL SALES)

  1. Buyers must 18 years or older.
  2. PSU reserves the right to accept or reject any and all bids and to sell any part or all of the offered property to PSU departments, state and local governments, and nonprofit organizations with a a 501(c)(3) status prior to the end of the sale.
  3. Portland State University's interest in the property passes to the successful bidder at the time of announcement of award. At this time, risk of loss or damage will not release the bidder from the obligation to buy the property. However, until the property is paid for, Portland State University retains possession, as security toward the entire payment of the purchase price. Prior to possession of the property by the purchaser, when legal title of ownership passes from Portland State University to the purchaser, the University may, if it decides that it is necessary, practical, or convenient, move any items. Loading and transporting items are the responsibility of the successful Bidder.
  4. Buyers are expected to remove items and equipment immediately at time of purchase unless an special arrangement has been agreed to with Surplus Property Manager. Ownership of items that are not removed within the agreed upon time period may revert to Portland State University.
  5. Bidders/Buyers may be barred from participating in Portland State University public sales for any of the following reasons:
    • Failure to observe the terms and conditions as set forth by PSU.
    • Payment for purchases with cashier's checks or credit cards which are dishonored by a payor bank, depository bank, intermediary bank, collecting bank, presenting bank or remitting bank.
    • Failure to pay for purchases.
    • Failure to remove purchased property within a reasonable period as agreed at time of sale.
    • Advertising any items listed on PSU's website for resale while PSU retains ownership.
  6. All property is offered for sale "as is, where is, with no guarantee". PSU makes no warranty expressed or implied as to the quality, weight, size or description of any property or its fitness of any use or purpose. All sales are final; NO REFUNDS WILL BE ISSUED for any reason once property has been removed.

Surplus Store Terms and Conditions

  1. Property is advertised to the public through our web listing at www.pdx.edu/surplus/items-for-sale and only the items advertised on our web listing are available for sale. You do not need to be PSU staff, faculty or a student in order to purchase surplus property.
  2. As of January 1, 2020 PSU only accepts payments made with debit or credit cards. Credit/debit transactions must be conducted in-person; PSU may require additional identification to confirm buyer's identity. Purchases cannot be performed over the phone.
  3. Cashier's checks or business checks may be accepted as payment on a case-by-case basis only. Personal checks are not accepted.
  4. Pricing is fixed; equipment is offered for sale at the advertised price ONLY.
  5. All property is sold on a first come, first serve basis. Portland State University cannot reserve any item advertised for sale for a customer. Every effort is made to ensure that product listings are accurate, but interested buyers are encouraged to contact Surplus Property prior to arrival to verify if a listed item is still available for sale.

Online Auction Terms and Conditions

  1. Buyer must be registered, and in good standing with our partnered auction vendors (Govdeals, Public Surplus, etc.)
  2. Shipping and removal must be arranged through a third party service (Fedex/UPS/etc.). Portland State University CANNOT ship or prepare shipping for any goods purchased through online auctions.
  3. Buyer is responsible for paying processing charges, buyer premiums, shipping or insurance charges when necessary or applicable.
  4. Payments must be received within 5 business days after successful bidders have been notified by applicable Internet vendors.
  5. Removal of equipment is the sole responsibility of the successful bidder and must be completed within 10 business days of the end of the auction (unless specific arrangements have been made with Asset Contact. Buyer may be assessed a storage fee of $10.00/day for any property remaining after 10 business day time limit has elapsed. Any item with pickup fees may not be removed prior to settling cost of any fees assessed.
  6. Property that has not been removed after 15 business days will revert ownership to Portland State University unless special arrangements have been made with Asset Contact. Any monies paid for forfeited property will NOT be refunded.
  7. Partnered auction vendors may apply additional terms and conditions for items advertised through their marketplace. Buyer is solely responsible for researching these terms and conditions prior to bidding, if any exist.

Basic Sealed Bid Auction Terms and Conditions

  1. Bids must be accompanied by a completed Bid Submission form and submitted through email or mail methods described therein.
  2. All bids and bid forms must be received before end-of-day on the closing date to be considered.
  3. Terms and conditions related to payment or removal of items offered through sealed bid auctions are the same as those described above for items offered through the Surplus Store.
