These processes are also determined by laws and regulations as well as collective bargaining agreements that may or may not apply to your position.

Employee Accommodations

PSU strives to maintain an inclusive work environment, including a welcoming environment for individuals with disabilities. PSU provides reasonable accommodation for employees with disabilities to enable successful performance.

The Americans with Disabilities Act of 1990 (ADA) ensures equal opportunities for persons with qualifying disabilities in employment. The law allows for reasonable accommodation to be made in the workplace so applicants and employees can effectively perform the essential functions of the position.

Portland State University will make reasonable accommodations for known physical or mental disabilities of an applicant or employee as well as known limitations related to pregnancy, childbirth or a related medical condition, such as lactation, unless the accommodation would cause an undue hardship.

Among other possibilities, reasonable accommodations could include:

  • Acquisition or modification of equipment or devices;
  • More frequent or longer break periods or periodic rest;
  • Assistance with manual labor; or
  • Modification of work schedules or job assignments.

Protected Leaves

Portland State employees have access to a number of protected leaves under federal and/or state law, administrative rules, collective bargaining agreements, or University policy.

These are available to employees who need to be away from the job due to illness, injury, academic pursuit, civic responsibility, military needs, inclement weather, and other events.

Important Note

It is the employee's responsibility to notify both their Supervisor and HR Leaves of medical/family leave, workers compensation claims or applicable changes. Failure to do so will result in delayed or denied benefits depending on the administering agency.

Employee Wage & Hour Laws

Employers in the U.S. are obligated to comply with a number of wage and hour laws which provide protections for employees based upon several factors. Collective Bargaining

The Public Employee Collective Bargaining Act (PECBA), ORS Chapter 243.650-243.806, recognizes the right of public employees to organize and engage in collective bargaining, and establishes a uniform process for employees to join and be represented by labor organizations (a.k.a. unions) of their own choice. PECBA also establishes a collective bargaining process for Oregon’s public employers and unions representing public employees. The full text of PECBA and the Employment Relations Board (ERB) rules can be found in ERB’s Rules which are posted on ERB’s website, http://www.oregon.gov/ERB.

ERB does not administer federal labor laws, such as the National Labor Relations Act (NLRA) (which covers most private sector employees), the Federal Labor Relations Act (FLRA) (which covers federal government employees), and the Railway Labor Act (RLA) (which covers railway and airline employees).

ERB also does not administer other federal and state employment laws, such as laws that set wage and hour standards, provide for medical or sick leave, or prohibit discrimination on the basis of protected status, including race, color, sex, religion, sexual orientation, national origin, age, disability, and veteran status.
